How long does an eviction take in Michigan?

Typically 4 to 8 weeks from the initial notice to removal. The process includes serving a notice (7-day for nonpayment, 30-day for lease violations), filing in district court, attending a hearing, and enforcing a Writ of Restitution. Having an attorney avoids common procedural errors that cause delays.

Can a landlord evict without going to court?

No. Michigan law prohibits "self-help" evictions. A landlord cannot change locks, shut off utilities, remove doors, or physically remove a tenant without a court order. Doing so exposes the landlord to civil liability. Every eviction must go through the district court process.

What are my rights as a tenant in Michigan?

Michigan tenants have the right to habitable living conditions, proper notice before eviction, return of security deposits within 30 days, protection from retaliation, and freedom from housing discrimination. The Truth in Renting Act prohibits lease provisions that waive these rights.

How much can a landlord charge for a security deposit?

Under MCL 554.602, the maximum security deposit is 1.5 months' rent. The landlord must hold it in a regulated financial institution, provide the bank information within 14 days, and return it (or an itemized deduction list) within 30 days of lease termination. Violations can result in double damages.
